SME Solutions Group Ltd ta SME Formations ("we", "us", "our") strives to provide clarity and transparency regarding your rights to refunds and cancellations. This policy summarises the circumstances under which services may be cancelled, and refunds issued, in accordance with our Terms and Conditions.

All terms used in this policy shall have the same meanings as those defined in our Terms and Conditions.

3. Cancellation and Refund Rights

We outline below the scenarios in which you or we may cancel a service and the applicable refund terms. Referenced clause numbers correspond to the clauses in our Terms and Conditions.

4. Your Right to Cancel and Receive a Refund

  • Additional Services (Clause 5.3): You may cancel within 14 calendar days if work has not commenced.
  • Company Formation Services (Clause 16.1): Cancellations within 14 days are eligible for a refund if the application has not been submitted.
  • Company Address Services (Clause 16.2): Refunds available within 14 days if work has not commenced; otherwise, an administration fee applies.
  • Force Majeure Events (Clause 10.1): Services may be cancelled if a Force Majeure event lasts more than 14 working days.

5. Cancellations Without a Refund

  • Renewable Services (Clause 5.4): Refunds are not provided for cancellations after renewal.
  • Company Formation Applications (Clause 16.1): No refunds once an application has been submitted to Companies House.
  • Non-Compliance (Clause 4.3): Services may be cancelled without a refund for failure to provide required KYC and ID information or for illegal activities.

6. Our Right to Cancel and Issue a Refund

  • Serious Errors (Clause 5.5): We may cancel services due to pricing errors, with refunds issued.
  • Unlawful Activities (Clause 16.2): Immediate termination may apply if continuing services would breach compliance regulations.
  • Force Majeure Events (Clause 10.1): Refunds apply if services are cancelled due to Force Majeure events lasting over 14 working days.

7. Cancellation Notice Requirements

Notices must:

  • Be provided in writing (email or post).
  • Be in English.
  • Include your name, contact details, and service reference.
  • Be signed.

8. Additional Considerations

  • No refunds for Overseas Compliance Review Fees (Clause 16.2).
